X. AMERICAN STATE TRIALS.

after the elevator and freight
that come in and out and people
that eome in and out. The ele-
vator was locked Friday night
when I left there; went off from
there Saturday and forgot to
lock it. Don’t remember stating

that T locked it Saturday; di

say in an affidavit it ie kept
locked all the time. Left the
factory at 11:45 on Saturday;
about 9:30 Mr, Frank and Mr.
Darley went over to Montag
Bros,; have seen Gantt talking to
Mary Phagan frequently.

Cross-eramined, Never seen
Mr. Frank speak to Mary Pha-
gan.

To Mr. Dorsey. On May 12,
1013, I told you that the ele-
vator was locked because I for-
got to tell you I done some saw-
ing; took the key ont, left the
elevator unlocked and took the
key back and put it in the office.

N,V. Darley, Am manager
of the Georgia Cedar Company,
a branch of the National Pencil
Company; was at the
Saturday, April 26th; saw Mr.
Frank, T was there Sunday
morning at about 8:20; saw Mr.
Frank; noticed his hands were
trembling; observed that he
seemed atill nervous when he
went to nail up the back door.
He said that he hed not had
breakfast and didn’t get any cof-
fee and that they had rushed him
‘by Bloomflelds, carried him in a
dark room and turned the light
on and he saw the girl instanily
and that was why he was ner-
vous. Newt Lee seemed to be
thoroughly composed. Heard
bim speak of the murder numer-
ous times, When we started
down the elevator Mr. Frank was
nervous, shaking all over. I

hia whole body was shaking or
not, but he was shaking.

Don't think a day passed at
the factory that Mr, Frank did
not get nervous. When anything
went wrong he would wring his
‘hands and I have seen him push
‘bis hands through his hair. When
things went wrong it would up-
eet him. If anything ont of the
ordinary happened I have seen
him a thousand times, I suppose,
rub ‘bis hands. Never saw Mr,
Frank speak to Mary Phagan;
don’t know whether he knew her
or not; didn't know we had a
girl by that name in the factory
until I found it out afterwards.

W. F, Anderson. Waa at po-
lice headquarters April 26th;
Bot a call from the night watch-
man at the pencil factory that
® woman was dead at the fac-
tory; asked him if it was a white
woman or 8 negro woman. He
said it was a white woman; went
there and Newt Lee came down
from the second floor. I called
up Mr. Frank on the telephone
2t 3:30 or 4 and got no answer.
