Motion to Advance Case Is Made in U. S. Court Monday (By Associated Press.) WASHINGTON, Jan. 25. Attorneys for Leo M. Frank, convicted for the murder of Mary Phagan, the Atlanta, Ga., factory girl, today filed a motion in the Supreme Court for an early hearing of his appeal from the habeas corpus decision in his case given by the Federal District Court of Northern Georgia. The statement was made that Attorney General Grice, of Georgia, agreed that "the interests of the appellant, and of the public, demand a speedy hearing and a determination thereof." Owing to the pressure of engagements in other courts, it was stated in the motion, the Attorney General was unwilling for the hearing to be set for a date earlier than February 22.

PAGE 5, COLUMN 7 CASE OF LEHON, THURMAN AND TEDDER POSTPONED Solicitor Plays Safe and Has New Indictments Drawn Against Them The trial of Dan S. Lehon, C. C. Tedder and Arthur Thurman on indictments charging subornation of perjury in the Frank case, Monday morning was postponed until Tuesday morning at 9 o'clock. This is the third or fourth time the trial has been postponed. Solicitor Hugh Dorsey Monday morning, before the case was called, for the third time went before the grand jury and presented new indictments against the three men. His drawing of the third set of indictments was prompted by a little byplay between him and Judge Arthur Powell, who represents them, in the court room last Thursday, when the case was scheduled, but postponed. Judge Powell told the solicitor it made no difference to him when the case was tried, as he was going to knock out the indictments, anyhow. And just to show the solicitor his confidence, he gave him a copy of his demurrer. After examining it, Solicitor Dorsey decided to draw new indictments, calling a special meeting of the grand jury for this purpose early Monday morning.
