Washington, January 25. (Special.) Counsel for Leo M. Frank, convicted of the murder of Mary Phagan, made a formal application to the Supreme Court today to advance the date for a hearing argument on the habeas corpus proceedings, begun before Judge W. T. Newman in Atlanta.

It was stated in the application that Warren Grice, Attorney General of Georgia, was willing to have the hearing set for any day after February 22, as he would be busy in other courts until then. The Supreme Court took the application under advisement.
