Read and considered, it is ordered that this petition and order be filed and duly entered upon order that said named suspects in connection with the Phagan murder, and now held in common jail of said county, to wit, Leo M. Frank and Newt Lee, be either personally or by serving their attorneys, and either citizens of said county who may receive this notice by publication or otherwise, may show cause before me, Friday, the 13th day of June, at 10 o'clock a.m. or as soon thereafter as the matter can be heard in my chambers in the thrower building, Atlanta, Ga. ingt copy of this order by the sheriff or one of his deputies by leaving June 11, 1913.

Service acknowledged and further service waived. The confinement of said James Connelly in the police station was at my request and at the request of my client James Connelly and I agree until the time of his trial he remain in custody of the police authorities of Atlanta. I, Lee M. Frank, consent until the indictment of said James Connelly against said James Connelly because he is a material witness for the state and I desire to have him present at the trial of said James Connelly and to safeguard said James Connelly from possible violence while in the jail to torture and intimidate said James Connelly and to have been made by him. I waive-his presence at the time of this trial.

Roan, Judge of the Superior Court, Criminal Division of said County, on the 11th day of June, 1913, hereby acknowledges service of said order as referred to the said Newt Lee, who is being held in the Fulton County common jail upon the order of Paul Donehoo, coroner of said county as a suspect in the Mary Phagan murder case.

And now comes James Connelly, and in answer to the rule nisi issued in the above case, shows to the court as follows:

1. Respondent admits that he is now held in custody under orders of this court, at the police prison of the city of Atlanta, having been originally held in the common jail of Fulton County, also under order of this court, the cause of said commitment by this court was respondent above the alleged crime of murder of Mary Phagan, and it is desired to insure the presence of respondent at the trial of the above case.

2. Respondent admits that he is now at the city police prison at his own request and instance, and through the advice and counsel of his attorney.
